“The WWE RAW Ringside Sweepstakes” USA Network Official Rules
DURATION AND TERRITORY.
No purchase necessary. Void where prohibited or restricted by
law."The WWE RAW Ringside Sweepstakes" ("Sweepstakes") will commence at
12:00 am (ET) on, Monday, September 19, 2005 and end at 11:59 p.m. (ET)
on Monday, October 17, 2005 (the “Sweepstakes Period”). All
entries shall become the sole property of Universal Television Networks
(“UTN”) and will not be returned. At the end of the Sweepstakes
Period, one (1) winner will be selected to win the Grand Prize, one (1)
winner will be selected to win the First Prize, and ten (10) winners
will be selected to win Second Place Prizes as set forth in Section 5
below. UTN, 30 Rockefeller Plaza, 21st Floor, New York, NY 10020, is
the sponsor of the Sweepstakes (“Sponsor”).
ENTRY.
To enter the “Sweepstakes”, an individual must visit UTN’s website
(http://www.usanetwork.com) during the Sweepstakes Period and follow
the instructions included therein.
All entries must contain the following information:
a) Entrant’s name;
b) Entrant’s daytime telephone number;
c) Entrant’s home address;
d) Entrant’s e-mail address (if applicable); and
e) Entrant’s date of birth.
Only one online entry per day per person will be accepted during the
Sweepstakes Period.
Multiple on-line entries from the same person on the same day will be
disqualified. Entries generated by a script, macro or other automated
means will be disqualified. UTN, Universal Studios, NBC Universal,
Inc., The Regan Group, The Promotional Edge, World Wrestling
Entertainment, Inc. ("WWE"), each of their respective parent,
subsidiaries, joint venture companies, affiliates, advertising and
promotion agencies and each of their respective owners, shareholders,
officers, directors, agents and employees and any other entity or
person involved in the development, administration or operation of this
Sweepstakes (collectively, the “Other Entities”), shall not be
responsible for late, lost, misdirected, incomplete, or illegible
entries; technical or software malfunctions; lost or unavailable
network connections; damage to entrant’s computer systems as a result
of entry in the Sweepstakes or downloading of any information necessary
to participate in the Sweepstakes; failed, incorrect, inaccurate,
incomplete, or delayed electronic communications, whether caused by the
sender or by any of the equipment or programming associated with or
utilized in this Sweepstakes; or by any human (or other) error which
may occur in the processing of the entries or the administration of
this Sweepstakes and Prizes; or printing or other errors. UTN
reserves the right in its sole discretion to cancel or modify the
Sweepstakes should any computer virus, malfunction or other cause
beyond its control corrupt the administration, security or proper
operation of the Sweepstakes. In the event of cancellation,
prizes will be awarded from among all eligible, non-suspect entries
received prior to the event requiring cancellation. Notice of
cancellation will be posted at www.usanetwork.com. Any
attempt to deliberately damage the Sweepstakes or operation of the
Sweepstakes is unlawful and subject to legal action by UTN which may
seek damages to the fullest extent permitted by law. Entries that are
garbled or unintelligible for any reason including, but not limited to,
computer or network malfunction or congestion (including at UTN), are
not eligible. By entering the Sweepstakes, entrants agree to
abide by all terms of the Official Rules applicable thereto and the
decisions of UTN which are final. Entrants agree to waive any
right to claim any ambiguity or error in these Official rules, or the
Sweepstakes itself, and agree to be bound by these Official Rules.
ELIGIBILITY.
Entrants must be 18 years of age or older as of September 19, 2005, be
a legal resident of the forty-eight (48) continental states of the
United States or the District of Columbia. and have
internet access as of September 19, 2005. Residents of Alaska and
Hawaii are not eligible. Employees of UTN or any of the Other Entities,
or of any of their respective parent or related companies, or of any of
their respective affiliates, subsidiaries, agents, or advertising and
promotional agencies, and any members of the immediate families of such
individuals (meaning spouses, parents, siblings and their respective
spouses), and any person living in the same household with such
individuals (whether or not related), are not eligible to enter.
WINNER SELECTION AND NOTIFICATION.
Winners will be chosen randomly from all eligible entries in a drawing
to be held on or about October 18, 2005 by USA Network. The first
(1) entry drawn will win the Grand Prize described in Section 5
below. The next (1) entry drawn will win the First Prize as
described in Section 5. The next ten (10) entries drawn will win the
Second Prize as described in Section 5. The winners will be notified by
phone, email and/or mail within fourteen (14) business days after the
drawing date. If a dispute arises regarding who submitted an on-line
entry, the entry will be deemed submitted by the holder of the e-mail
account as determined by UTN. All decisions by UTN regarding this
Sweepstakes shall be final, binding and cannot be
appealed. All entries become the property of UTN and
will not be acknowledged or returned. The Grand Prize and First Prize
Winners will be required to return a completed, signed and notarized
affidavit of eligibility and release of liability and, except where
prohibited, a publicity release within five (5) days of such
notification. Noncompliance within this time period, or the
return of any prize notification as undeliverable for any reason, or
failure to abide by these Official Rules, will result in
disqualification of any selected entrant and prize forfeiture and an
alternate winner will be selected and confirmed in accordance with
these Official Rules. The odds of winning this Sweepstakes
depends upon the number of valid entries received. All prizes
will be awarded after total compliance with all terms and conditions of
these Official Rules.
PRIZES.
There will be one (1) Grand Prize winner, one (1) First Prize winner
and ten (10) Second Prize winners. The Grand Prize shall consist
of a trip for the winner and three (3) guests to Miami, FL to attend
WWE's Royal Rumble on January 29th, 2006, and shall include: roundtrip
coach air transportation for winner and guests from the major airport
nearest the winner's residence (as determined by Sponsor in its sole
discretion) to Miami, FL; hotel accommodations for the winner and
guests (two standard rooms, double occupancy) for three (3) nights;
airport transportation to/from hotel; one dinner for four on the night
of arrival; breakfast for four for up to three consecutive days;
transportation from hotel to the location of WWE's Royal Rumble; four
tickets to WWE's Royal Rumble; backstage tour for four prior to the
event; and $500 spending money for the winner. The total
approximate retail value ("ARV") of the Grand Prize is $10,000.00
(actual value depends on airport city of departure). One (1)
First Prize winner shall receive one (1) WWE RAW Ultimate Home
Entertainment Pack, which includes: one (1) HDTV Flat Screen; one (1)
CD/DVD/Stereo Surround Sound System; one (1) X-Box gaming system; one
(1) WWE Wrestlemania 21 video game for Xbox; delivery of the system
with a RAW superstar in attendance; installation of the system up to a
cost of $500; one (1) John Cena Jersey. The ARV of the First Place
Prize is $7,000.00. Ten (10) Second Prize Winners shall each receive
one (1) WWE RAW Prize Pack, which includes: one (1) John Cena Jersey;
one (1) John Cena CD You Can’t See Me; one (1) WWE RAW vs. Smackdown
video game for Playstation; one (1) t-shirt; one (1) hat. The ARV of
each Second Place Prize is $169.00. Total ARV of all Prizes:
$18,690.00. Each Winner is solely responsible for all federal, state,
and local taxes on prize, and for any ground transportation, meals,
gratuities, travel upgrades, personal incidentals, and any other
expenses not specified herein. Certain blackout periods and travel
restrictions may apply. The value of a prize is determined by the Grand
Prize donors and is final for all purposes. The Grand Prize must be
accepted and enjoyed by winner by January 29th, 2006. If a
prize cannot be accepted as stated, it will be forfeited and awarded to
an alternate winner. Grand Prize Winner’s travel guests must be
the age of majority in his or her state of residency or Winner must be
guest’s parent or legal guardian. Grand Prize winner’s guests, if
any, must complete a liability and publicity release, or prize will be
forfeited and an alternate winner selected. All travel and hotel
arrangements to be determined by Sponsor in its sole discretion.
Sponsor in its sole discretion, reserves the right to provide ground
transportation in lieu of air transportation. All travel and hotel
arrangements to be determined by Sponsor in its sole discretion. Grand
Prize Winner and guests must travel on the same itinerary and at times
required by Sponsor. All travel and lodging will be at risk of
Grand Prize Winner and guests. If a prize winner’s notification
is returned as undeliverable, a prize winner is ineligible or otherwise
declines prize, or if Grand Prize Winner is unable to travel on dates
specified by Sponsor, then prize will be forfeited and an alternate
winner will be selected at random from all remaining eligible entries
received that have not already been selected for another prize.
The prizes are neither transferable nor assignable and may not be
exchanged for cash; however, UTN reserves the right to substitute a
prize of comparable or greater value in the event a prize cannot be
fulfilled.
CONDITIONS.
By entering this Sweepstakes, each entrant agrees (a) to release and
hold harmless UTN, and the Other Entities, their respective parent and
related companies, and any of their respective affiliates,
subsidiaries, agents, and advertising and promotional agencies, and the
respective officers, directors, shareholders and employees of the
foregoing entities, from any and all liability, illness, injury, death,
loss, litigation or damage that may occur, directly or indirectly,
whether caused by negligence or not, from such entrant’s participation
in this Sweepstakes and/or his or her acceptance, possession, use or
misuse of a prize, or any portion thereof; (b) if selected as the Grand
Prize or First Prize Winner, to the posting of such entrant’s name on
www.usanetwork.com and the use by UTN and any of the Other Entities of
entrant's name, likeness, personal information and/or photograph (if
any) for publicity, promotional and advertising purposes in any medium
including, without limitation, print, television, radio or the
Internet, without additional compensation, to, or authorization
from, the entrant. The use of such entrant’s name, likeness and
other information by UTN shall be subject to UTN’s privacy policy
located at www.usanetwork.com/privacy. UTN reserves the right to
select a new winner for any given prize if it has any reason to suspect
any technical corruption or any non-authorized human intervention by,
or on behalf of, the initial winner. In the event more winner
notifications are issued, or more winning prize claims are received,
than the number of prizes set forth in these Official Rules due to
computer, printing, seeding, human or other error or problem, a random
drawing will take place from all eligible prize claims for the prize at
issue to award the proper number of prizes as set forth in these
Official Rules. This Sweepstakes is void where prohibited or restricted
by Federal, State, or local laws and is subject to all applicable
Federal, State, and local laws.
The failure of Sponsor to comply with any provision of these Official
Rules due to an act of God, hurricane, war, fire, riot, earthquake,
terrorism, act of public enemies, actions of governmental authorities
outside of the control of Sponsor (excepting compliance with applicable
codes and regulations) or other force majeure event will not be
considered a breach of these Official Rules.
WINNER’S LIST/OFFICIAL RULES.
For the names of the prize winners or a copy of the Official Rules,
mail a self-addressed, stamped envelope to UTN, Attn: USA
Network, 30 Rockefeller Plaza, 21st Floor, New York, NY 10112 (VT
residents may omit postage). Be sure to specify “WWE RAW Ringside
Sweepstakes” on the outside of your envelope. Requests for the
names of the prize winners must be received by UTN by October 18,
2005. Requests for copies of the Official Rules must be received
by UTN by October 18, 2005.
CONSTRUCTION.
All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules or the rights
and obligations of any entrant, UTN and Other Entities shall be
governed by and construed in accordance with the laws of the State of
New York. In any action brought to enforce the obligation or
right of any party hereunder they consent to personal jurisdiction and
venue in any court of appropriate jurisdiction in New York County, New
York The invalidity or unenforceability of any provision of
these Official Rules shall not affect the validity or enforceability of
any other provision.
