OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. The Burn Notice "Lunch with a Cast Member" Sweepstakes (the "Sweepstakes") is sponsored by USA Network, a division of Universal Television Networks ("Sponsor"), 30 Rockefeller Plaza, 21st Floor, New York, NY 10112.
1. ELIGIBILITY: Open only to permanent legal U.S. residents physically residing in the forty-eight (48) Continental United States and the District of Columbia (residents of Alaska, Hawaii, Guam and Puerto Rico are excluded from entry and participation), who are 21 years of age or older at time of entry. Employees of Sponsor, and its respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and any other person or entity involved in the development or administration of the Sweepstakes, and their immediate family members (parent, child, spouse, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible to participate in or win the Sweepstakes. Void where prohibited by law. All applicable federal, state and local laws apply.
2. HOW TO ENTER: Beginning 10:00pm Eastern Time ("ET") on August 23, 2007 through 11:59pm ET on September 26, 2007 (the "Sweepstakes Period"), participants may enter the promotion by 1) logging on to burnnotice.usanetwork.com (the "Website") and 2) once there, clicking on The Burn Notice on-line game (the "Game") and following the instructions on how to enter (including completing the official entry form.) Each week during the Sweepstakes Period when you return to the Website and the Game, you will enter a user name and password that will provide one (1) additional entry into the Sweepstakes (subject to the entry limitations described below). Participants may also enter the promotion without participating in The Burn Notice Game by logging on to burnnotice.usanetwork.com and clicking on the Sweepstakes banner and following the on-screen entry instructions to enter without registering for (or logging into) the Game. All participants who successfully complete either entry process, will be entered into the Sweepstakes. All entries must contain the following information: All entries must contain the following information:
a) Entrant's name;
b) Entrant's daytime telephone number;
c) Entrant's home address;
d) Entrant's e-mail address (if applicable); and
e) Entrant's date of birth.
Participants may enter up to a total of five (5) times throughout the Entry Period. All Entries must be received by 11:59pm ET on October 10, 2007. Limit five (5) entries per unique email address or person or household throughout the Entry Period as determined by name and unique email address. Entries received in excess of this limit from any unique email address or person or household during Entry Period will be void. Entries generated by script, macro or other automated means are void. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. All entries become the property of the Sponsor.
3. RANDOM DRAWING/WINNER NOTIFICATION: One (1) potential Grand Prize Winner will be selected in a random drawing on or about October 15, 2007 from among all eligible entries received during the Sweepstakes Period by Sponsor, whose decisions are final and binding with respect to all matters related to the Sweepstakes. Odds of winning will depend upon the number of eligible entries received. Sponsor will make two (2) attempts to contact the potential Grand Prize Winner at the phone number or email address provided at time of entry within seventy-two (72) hours from the time of winner's selection. If Sponsor is unable to reach a potential winner via phone or email within this time frame, he/she may be disqualified and an alternate may be selected. Potential Grand Prize Winner will be required to complete, sign, have notarized, and return an Affidavit of Eligibility and Liability Release Publicity Release (where legal) within seven (7) days of date of attempted notification. If the Affidavit and Release and the Publicity Release are not returned within such time period, the prize may be forfeited and an alternate winner may be selected at random from among all eligible non-winning entries received. If any prize notification communication or correspondence of any kind or any prize is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner.
4. PRIZE: Sponsor will award to one (1) Grand Prize Winner one (1) Grand Prize, consisting of a trip for two (2) to Los Angeles, CA to have lunch with a member of the Burn Notice Cast (the "Trip"). The Trip includes (i) round-trip coach class air transportation for Grand Prize Winner and his or her guest ("Guest") from major U.S. gateway airport nearest winner's residence (as determined by Sponsor) to one of the three major gateway international airports nearest Los Angeles, CA (as determined by Sponsor), (ii) three (3) days and two (2) nights hotel accommodations (standard room, double occupancy), as determined by Sponsor in its sole discretion, (iii) Five Hundred Dollars ($500.00) to the Grand Prize Winner, (iv) breakfast (up to two (2) mornings) at the hotel for the Grand Prize Winner and Guest, (v) transportation between the airport and hotel, (vi), lunch with a Burn Notice Cast Member ("Lunch") (time and location of Lunch to be determined by Sponsor in its sole discretion, and subject to availability and event exigencies), and (vii) up to two (2) dinners in Los Angeles, CA provided by Sponsor, at locations to be determined by Sponsor in its sole discretion.
All prize details are at the sole discretion of the Sponsor. The Trip must be taken on dates designated by Sponsor. Grand Prize Winner and Guest agree that they undertake the Trip at their own risk. Grand Prize Winner and Guest must travel together on the same itinerary, including the same departure date, destination and return date and must have valid travel documents (e.g., valid government issued photo ID) prior to departure, and failure to do so will result in forfeiture of prize. Guest must complete a travel guest liability/publicity release prior to the Trip, or this portion of the Grand Prize may be forfeited. Grand Prize Winner's travel companion must be the age of majority in his or her state of residency or Grand Prize winner must be travel companion's parent or legal guardian and must complete and return all releases on behalf of minor.
The Grand Prize Winner is solely responsible for all expenses and costs associated with acceptance and/or use of any prize not specifically stated herein as being awarded, including, without limitation, and all federal, state and local taxes. Sponsor disclaims any and all liability for the actual provision, quality or nature of any product or service accepted by any winner. Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. All travel and lodging will be at the risk of winner and travel companion.
No transfer, substitution, assignment or cash redemption will be awarded in lieu of stated prize except by Sponsor who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. In the event that any prize component is not available for any reason (including, without limitation, the Lunch with a Burn Notice Cast Member) is unavailable for any reason, then remaining elements of prize shall constitute full satisfaction of Sponsor's prize obligation to winner and no additional compensation will be awarded. If Grand Prize Winner cannot accept any prize as stated, the prize will be forfeited, and at Sponsor's discretion, an alternate winner may be selected.
Approximate Total Retail Value of Grand Prize: $4999. The attendance at the Lunch of a Burn Notice Cast Member has no cash value. The value of each prize represents Sponsor's good faith determination of the maximum retail value thereof. For Form 1099 reporting purposes, each winner shall be bound by such good faith determination.
5. GENERAL RULES: Acceptance of prize constitutes permission to the Sponsor and its respective designees to use winner's name, city, state, likeness, voice, biographical information and statements for purposes of advertising, promotion and publicity in any and all media, now or hereafter known, throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law. By participating, entrant (i) agrees to release and hold Sponsor, NBC Universal, Inc., their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective directors, officers, employees and assigns (collectively, the "Released Parties"), harmless against any and all claims and liability arising in whole or in part, directly or indirectly, out of participation in the Sweepstakes or misuse, nonuse or use of the prize (including any travel or activity related thereto); (ii) waives all rights to claim punitive, incidental and consequential damages, attorney' fees or any damages other than actual out-of-pocket costs incurred to enter; (iii) agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding on all matters relating to the Sweepstakes; (iv) agrees to waive any right to claim any ambiguity or error in these Official Rules or the Sweepstakes itself.
Released Parties are not responsible for incomplete, lost, late, stolen, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries; for any computer, network, technical, mechanical, printing, typographical, human or other errors or problems of any kind relating to or in connection with the Sweepstakes, including, without limitation, errors or problems of any kind that may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement, delivery or use of any prize or in any Sweepstakes-related materials; or for any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes. CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law, including criminal prosecution.
If for any reason this Sweepstakes is not capable of being run or implemented as planned (as determined by Sponsor in its sole discretion), including, but not limited to, as the result of infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, or any other cause of any kind, which, in Sponsor's sole judgment, is likely to or actually corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend all or any part of the Sweepstakes, or to disqualify any implicated entrant(s) (and their entries), and the prize(s) (or any portion thereof) may not be awarded. In the event of cancellation, termination, modification or suspension, Sponsor reserves the right, at its sole discretion, to pick winners in a random drawing from among all eligible, non-suspect entries received up to the time of the event or action warranting such cancellation, termination, modification or suspension, as applicable. In the event this Sweepstakes is cancelled prior to the stated end date, a notice will be posted at burnnotice.usanetwork.com.
In the event a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. "Authorized account holder" is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
6. LIMITATION OF LIABILITY: Entrants and any winner agree that the Released Parties shall not be liable for injury, loss or damage of any kind resulting from participating in this contest or from the acceptance or use of any prize awarded, including any future use of the winning entry. Sponsor reserves the right (but are not obligated) to verify eligibility qualifications of any entrant or winner.
7. WINNERS' NAME: For the name of the Grand Prize Winner, available after October 15, 2007, send a self-addressed, stamped envelope to: The Burn Notice "Lunch with a Cast Member" Sweepstakes, c/o USA Network, 30 Rockefeller Plaza, 21st Floor, New York, NY 10112 to be received by December 31, 2007.
8. NO WARRANTIES: Sponsor makes no warranties covering any of the prizes furnished as part of this Sweepstakes.
9. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of New York. If any controversy or claim arising out of or relating to the Sweepstakes, the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York, and administered by Judicial Arbitration and Mediation Services ("JAMS") in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (the "JAMS Rules"). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in New York. The decision of the arbitrator shall be binding, final and conclusive and shall not be appealable to any court.
10. PRIVACY: Winner's names and contact information will be shared by Sponsor in order to contact winner for the purpose of fulfillment of prizes. Information supplied by non-winning entrants will be shared by Sponsor in accordance with its privacy policy, located at http://www.usanetwork.com/privacy.
