NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. The "Quiznos® Character Fantasy Contest" ("Contest") begins on April 28, 2008 at 12:00:01 a.m. Eastern Time ("ET") and ends on May 25, 2008 at 11:59:59 p.m. ET.
CONTEST IS OFFERED ONLY IN THE 48 CONTIGUOUS STATES OF THE U.S. (AND D.C.).
VOID IN HAWAII, ALASKA, GUAM, PUERTO RICO AND ALL OTHER U.S. TERRITORIES AND POSSESSIONS, AND WHERE PROHIBITED
1. Eligibility: Contest (as defined below) is only open to permanent legal residents of the forty eight (48) contiguous states of the United States ("U.S.") (including the District of Columbia) who are physically located and residing therein (excluding Hawaii, Alaska, Guam, Puerto Rico, and all other U.S. territories and possessions) and who are the age of majority in the jurisdiction in which they reside as of April 28, 2008. (For purposes of this Contest, the age of majority is eighteen (18) years of age in all of the United States of America and the District of Columbia, except in Alabama and Nebraska where it is nineteen (19) years of age and in Mississippi and Pennsylvania, where it is twenty-one (21) years of age.) Entrant may not be and may not intend to be, during six months from entrant's date of entry, a candidate for any public office. Entrant may not be a professional actor or a member of SAG, AFTRA, AGVA, Equity or any other guild or union associated with the performing arts. Employees of USA Network and NBC Universal, Inc. (collectively, "Sponsors") Quiznos®, QIP Holder LLC., Magical Elves, Contest administrator, their advertising or promotion agencies, those involved in the production, development, implementation or handling of Contest, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, service providers, prize suppliers, any other person or entity associated with Contest (collectively "Contest Entities") and/or members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether or not related are ineligible to enter Contest.
2. How to Enter: The Quiznos® Character Fantasy Contest begins at 12:00:01 a.m. ET on April 28, 2008 and ends at 11:59:59 p.m. ET on May 25, 2008 ("Contest Period"). Eastern Time shall control for all purposes of this Contest. To enter the Contest:
1. Access the Contest web site at http://www.characterfantasy.com ("Web Site") and click on the Quiznos® Character Fantasy icon or text link, which will take you to the Contest home page and entry form;
2. Follow the online instructions to complete and submit the Official Contest entry form in its entirety. Information required on the entry form consists of your first name, last name, complete address (including ZIP code; no P.O. Boxes), telephone number (including area code), gender, date of birth, and e-mail address;
3. Enter your answer ("Answer(s)") of 100 words or less (for each question) written in the English language to each of the following four questions ("Quiznos® Questions"): 1) Why are you passionate about food?; 2) What is your most delicious recipe and why?; 3) What is the best dining experience that you have ever had?; and 4) What distinctive talents or unique abilities do you possess that would make you a great host of a "chef inspired minute" with Quiznos®' Chef Zach?; and
4. Upload one (1) original photograph of yourself (photograph must be of entrant only) in JPG or GIF formats with a maximum size of 1MB), which best demonstrates why you deserve to be a Quiznos®' Executive Chef ("Photo")
(collectively "Entry" or "Entry Information"). Entries must be received by 11:59:59 p.m. ET on May 25, 2008. All required Entry information must be completed in full to be considered. Proof of delivery or receipt of any kind of Entry will not be deemed by Sponsors as proof of Entry. If an Answer to any of the four (4) Quiznos® Questions exceeds 100 words, only the first 100 words of the Answer will be judged. Answers must be entirely entrant's own work. Limit one (1) Entry per person during the entire Contest Period. Entries in excess of the stated limits by the same person will be disqualified. Any attempted form of Entry other than as described herein is void. Each Entry will be judged on the criteria set forth below. No Entry by a group or organization will be considered. Any Entry that contains information that is not reasonably pertinent to the judging criteria (described below), as determined by Sponsors and/or judges in their sole discretion, or is otherwise in violation of these Official Rules will be disqualified. As determined by Sponsors and/or judges in their sole discretion, any Entry that includes obscenities, objectionable material defames or invades the publicity or privacy rights of any person, living or deceased, or otherwise infringes upon any third party's personal or proprietary rights, including but not limited to copyright, trademark, privacy, publicity rights, will be disqualified. Entrant's Photo and Answer must not have been previously published or entered in any competition or contest. Entries also must not contain inappropriate or offensive material or libelous, tortuous, or otherwise unlawful information, or violate any federal or state statute or regulation. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. For participant's Entry to be valid and in order for his or her Answers to be considered, each entrant must acknowledge reading, accepting, and agreeing to all terms and conditions set forth in these Official Rules. All Entry Information is subject to USA Network's ("USA") Terms of Service located at http://www.usanetwork.com/terms/. Entrants must be of good moral character. Sponsors reserve the right to exclude anyone convicted of a crime (other than moving violations of a misdemeanor type that did not involve personal injury, drugs or alcohol). Entrants must have nothing in their background that would be an embarrassment to Sponsors. Sponsors reserve the right to exclude Entrants for these or any other reasons, in Sponsors' sole editorial discretion.
3. Judging: Eligible Entries will be judged in three (3) stages: 1) Semi-Finalist Judging conducted by Contest administrator; 2) Finalist Judging conducted by Sponsors' designated representative(s); and 3) Grand Prize Judging conducted by Sponsors' designated representative(s) (collectively "Judges"). All Entries must be received by 11:59:59 p.m. on May 25, 2008, BUT NOTE THAT THEY WILL BE REVIEWED ON A ROLLING BASIS AS THEY ARE RECEIVED.
4. Semi-Finalist Judging: On or about April 29, 2008, and continuing until on or about May 27, 2008, all eligible Entries will be judged by Contest administrator, an independent judging organization, who will select the top ten (10) Entries (each a "Semi-Finalist"). Answers to the Quiznos® Questions will be judged based upon the following criteria: 1) Originality; 2) Clarity of expression; and 3) Relevancy of Answer to the Quiznos® Question asked; ten (10) possible points for each criterion for a total of thirty (30) points maximum per Answer ("Answer Points") There are a total of one hundred and twenty (120) total Answer Points possible. Photos will be judged based upon the following criteria: 1) Self Expression; and 2) Visual Appeal; fiifteen (15) possible points for each criterion for a total of thirty (30) points maximum ("Photo Points"). The total amounts of the Answer Points and Photo Points from each entrant will be added together to create a total score (maximum of one hundred (150) points) ("Total Score"). The top ten (10) Entries that receive the highest Total Scores will be declared semi-finalists ("Semi-Finalists"), subject to compliance with these Official Rules. In the event of a tie, to determine the Entry that will move on to the Semi-Finalist Judging, the tied entrant who scored the most Answer Points to Quiznos® Question # 4 will be declared a Semi-Finalist. In the event of a further tie, the tied entrant who scored the most Answer Points to Quiznos® Question # 3 will be declared a Semi-Finalist. In the event of a further tie, the tied entrant who scored the most Answer Points to Quiznos® Question # 2 will be declared a Semi-Finalist. In the event of a further tie, the tied entrant who scored the most Answer Points to Quiznos® Question # 1 will be declared a Semi-Finalist. In the event of a further tie, the tied entrant who scored the most Photo Points will be declared a Semi-Finalist. In the event of any remaining tie, the tied Entries will be re-scored as above until the tie is broken. Judges have the right in their sole discretion to select fewer than ten (10) Semi-Finalists (or no Semi-Finalists at all) based on insufficient number of Entries received and/or if fewer than ten (10) entries score the minimum required Total Score of at least 100 points. Each Semi-Finalist's Entry will go on to the Semi-Finalist Judging stage, subject to compliance with these Official Rules.
5. Finalist Judging: On or about May 30, 2008 the ten (10) Semi-Finalist entries will be re-scored by a new panel of Judges (Sponsors' designated representatives) based upon the same criteria as the Semi-Finalist Judging as described above. The five (5) Entries that receive the highest scores ("Finalist Scores") will be declared finalists ("Finalists"), subject to compliance with the Official Rules. In the event of a tie, the tie-breaking procedure described above for Semi-Finalist judging will be used to break the tie. Judges have the right in their sole discretion to select fewer than five (5) Finalists (or no Finalists at all) based on insufficient number of Entries received and/or if fewer than five (5) entries score the minimum required Total Finalist Score of at least 100 points.
6. Grand Prize Judging: On or about June 4, 2008 Sponsors' authorized designee will attempt to notify the potential Finalists by phone between the hours of 2:00 pm ET and 6:00 pm ET at the phone number provided in each Finalist's Entry, to determine each Finalist's eligibility by conducting a Telephone Eligibility Questionnaire as well as to inform and schedule each Finalist's telephone interview with Sponsors on or about June 9, 2008. The five (5) Finalists will then be contacted by Sponsors' representative on June 9, 2008 between 12 noon ET and 4:00 pm ET at the phone number provided in each Finalist's Entry in order to conduct a Telephone Interview ("Interview") in accordance with these Contest Rules. Based upon each Entrant's Finalist Total Score and the results of the Telephone Interview, subject to compliance with these Contest Rules, the Sponsors' representative will select the potential Grand Prize Winner. Each Telephone Interview will be scored based on the following Interview criteria: 1) Articulation; 2) Confidence; 3) Enthusiasm and 4) Personality; twenty five (25) possible points for each criterion for a total of one hundred (100) points maximum ("Interview Score.") Each entrant's Interview Score will be added to his/her Finalist Score to arrive at his/her "Grand Prize Score", which has a maximum possible score of two hundred (250) points. The entrant with the highest Grand Prize Score will be declared the potential Grand Prize Winner. Any ties will be broken using the tie-breaking process set forth above in Semi-Finalist Judging, with the Telephone Interview tie breaking process being applied in the following order: 1) Articulation; 2) Confidence; 3) Enthusiasm and 4) Personality. If any potential Finalist cannot be reached by phone during such set time periods on or about June 4, 2008 or on or about June 9, 2008 as per the dates/times set forth in these Contest Rules and/or as scheduled with each Finalist; or if he/she is found to be ineligible or otherwise not in compliance with these Contest Rules; or if such person is reached but refuses to participate in the telephone interview in whole or in part; or does not answer questions during the telephone interview, such Finalist will be disqualified from continued participation in the Contest and Sponsors (in their sole discretion), may select an alternate potential Finalist from the next highest scoring eligible Semi-Finalist to replace the disqualified Finalist. Each such new potential Finalist, if any, must comply with these Contest Rules (including, without limitation, with all the eligibility requirements) in order to qualify as a Finalist to whom the Grand Prize may be awarded. If no eligible Finalists are available from which to select a Grand Prize Winner, or if it is determined by the Sponsors that a potential Grand Prize Winner is not eligible to win the Grand Prize in accordance with these Contest Rules, or if no Entry scores the minimum required number of points, then the Grand Prize will not be awarded.
7. Prizes: One (1) Grand Prize: There will be one (1) grand prize awarded, consisting of the following: One (1) trip to Los Angeles, CA ("Trip"), for potential Grand Prize Winner ("Winner") and his/her one (1) guest. Trip includes roundtrip, coach-class air travel from a major commercial airport near Winner's residence in the forty eight (48) contiguous states of the U.S. and D.C. (as determined by Sponsors) to one of the airports to Los Angeles, CA; standard hotel accommodations (single room/double occupancy) for two (2) nights (as determined by Sponsors in their sole discretion); ground transportation to/from Los Angeles, CA area airport and hotel; and the Grand Prize Winner (Winner only) will receive an opportunity to participate in the taping ("Role") of an episode of a USA Network Character Fantasy ("Upcoming Episode") (collectively, "Grand Prize"). Grand Prize Winner and his/her guest must travel together and must have valid travel documents (e.g., valid government issued ID) prior to departure on dates selected by Sponsors at their sole discretion or Grand Prize will be forfeited, and no other consideration or substitution will be given therefore, and, at Sponsors' sole discretion (and time permitting) an alternate potential Grand Prize Winner will be selected. The Approximate Retail Value ("ARV") of Grand Prize is two thousand dollars ($2,000). Actual value of Grand Prize will depend on point of departure and any airfare fluctuations; any differences will not be awarded. Grand Prize Winner and guest must be able to take Trip departing on or about July 17, 2008 and returning on or about July 19, 2008 (or on other dates and times specified by Sponsors at their sole discretion) or Grand Prize Winner will be disqualified and an alternate potential Grand Prize Winner may be selected at Sponsors' sole discretion. Nothing set forth herein shall be construed to require Sponsors to hold the selected taping of the Upcoming Episode. Role is the usage of the Grand Prize Winner's likeness, and is subject to the requirements of the Upcoming Episode's producer and approval, which may be granted or withheld at such producer's sole discretion. Participating in the Upcoming Episode is subject to and conditioned upon the Grand Prize Winner executing a certificate of engagement and/or other services agreement granting the producer of the Upcoming Episode all rights, titles and interests in and to the results and proceeds of the Grand Prize Winner's services on the Upcoming Episode throughout the universe, in perpetuity, and other provisions customary for talent services agreement in the entertainment industry. GRAND PRIZE WINNER'S APPEARANCE ON THE UPCOMING EPISPODE IS SUBJECT TO PRODUCER'S REQUIREMENTS AND SOLE DISCRETION, AND, PRIOR TO PARTICIPATION, WINNER WILL BE REQUIRED TO SIGN PRODUCER'S FULL STANDARD RELEASE AND TO SUBMIT TO PRODUCER'S STANDARD INTERVIEW AND SCREENING PROCESS AND ANY OTHER REQUIRED DOCUMENTATION. Grand Prize Winner's appearance may not actually appear in the final broadcast version of the Upcoming Episode; decision is subject to producer's requirements and sole discretion. Sponsors are not responsible or liable for cancellation or preemption of Grand Prize Winner's appearance in the Upcoming Episode. Role has no cash value. Grand Prize Winner will receive no compensation regardless of whether or not the Grand Prize Winner's Role actually appears in the Upcoming Episode. In the event that the taping of Upcoming Episode detailed in the Grand Prize description does not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, an event of force majeure, or for any other reason, then the remaining components, if any, of the Grand Prize shall constitute full satisfaction of Sponsors' prize obligation to the Grand Prize Winner, and no other or additional compensation will be awarded. If Upcoming Episode taping is cancelled or postponed during Grand Prize Winner's Trip for any reason, the taping portion of Grand Prize will be forfeited and no additional substitute prize or compensation will be provided in lieu thereof. If Upcoming Episode taping is cancelled or postponed prior to booking, Winner will have one (1) year from date of notification of winning to take Trip without the Upcoming Episode portion of Grand Prize. Grand Prize Winner and his/her guest must travel during the dates specified by Sponsors at their sole discretion or Grand Prize may, at Sponsors' sole discretion, be forfeited and no additional compensation will be awarded. Trip is subject to air travel and hotel availability, holiday and blackout dates, and all other prize and travel restrictions. The Grand Prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the Affidavit/Release (described below) and/or Grand Prize Winner's travel and/or producer's documents. Once determined, no change, extension or substitution of a Grand Prize Trip date is permitted, except by Sponsors at their sole discretion. Sponsors reserve the right to provide ground transportation in lieu of air transportation for Grand Prize Winner if he/she resides with in one hundred (100) miles of Los Angeles, CA. Grand Prize Winner's guest must be at least eighteen (18) years of age and also be the age of majority in the jurisdiction in which they reside as of April 28, 2008. Grand Prize Winner and guest must take air travel on same travel itinerary. If Grand Prize Winner elects to partake in any or all portions of his/her prize without a guest, no additional compensation will be awarded in place thereof. Grand Prize Winner is solely responsible for all costs, incidentals, and expenses not specifically mentioned as being included, including but not limited to, additional ground transportation, meals, phone calls, gratuities, insurance, security, airport fees, taxes, gasoline, and souvenirs. No substitution, transfer, or cash equivalent for any prize (or prize components), except that Sponsors may substitute a prize (or prize component) with one of equal value for any reason at their sole discretion. Prize notifications and prizes will be shipped to 48 contiguous states U.S. addresses only. All federal, State, or other taxes are the sole responsibility of the winners. Grand Prize Winner will receive a 1099 form from the Sponsors for the total ARV, as stated herein, of his/her prize that he/she won for the calendar year that he/she won. Sponsors will not replace any lost or stolen tickets, travel vouchers or certificates. Once travel commences, no unscheduled stopover are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Sponsors are not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. All travel and lodging will be at the risk of Grand Prize Winner and guest.
8. Grand Prize Winner Notification: Grand Prize Winner will be notified on or about June 11, 2008 by telephone (at the number provided on that entrant's Entry). If Grand Prize Winner cannot be reached within three (3) days of notification of winning, is found to be ineligible, or does not comply with these Official Rules, such potential Grand Prize Winner will be disqualified and the Finalist with the next highest score may be declared the Grand Prize Winner. Return of prize or prize notification as undeliverable will result in disqualification and an alternate potential Grand Prize Winner may be selected, at Sponsors' sole discretion. The remaining Finalists may receive a courtesy call from Sponsors' designee of his/her status, at Sponsors' sole discretion.
9. General Conditions and Disclaimers: Semi-Finalist, Finalist and Grand Prize Judging decisions are final and binding. This Contest is subject to these Official Rules and all applicable federal, state, and local laws. Potential Grand Prize Winner may be required to sign, execute, notarize, and fax an Affidavit of Eligibility and Liability Release ("Affidavit/Release") and Publicity Release and any other documentation that the Sponsors may require within two (2) days of receiving notification and return the originals by mail, or by mail service paid for by Sponsors, within five (5) days of receiving notification, or potential Grand Prize Winner will be disqualified and an alternate potential Grand Prize Winner may be selected at Sponsors' sole discretion. Guest of potential Grand Prize Winner will be required to execute, have notarized, and fax a Liability Release and Publicity Release ("Travel Guest Release") and any other documentation that the Contest administrator and/or Sponsors requires within two (2) days after receipt by potential Grand Prize Winner and return the originals by mail, or by mail service paid for by Sponsors, within five (5) days of receipt. By returning a completed Affidavit/Release and Publicity Release, Grand Prize Winner attests to the authenticity of his/her Answers and Photo and the provisions stated therein including compliance with these Official Rules. By entering the Contest, entrants agree to waive any right to claim any ambiguity or error in the Official Rules of the Contest, or the Contest itself, and agree to be bound by these Official Rules and by all decisions of the Sponsors and Judges, whose decisions are binding and final in all respects. Contest Entities are not responsible or liable for multiple Entries, or Entries that are entered by other than human means or Entries that are late, incomplete, lost, misdirected, forged, damaged, destroyed, tampered with, or otherwise not in compliance with these Official Rules, and all such Entries will be disqualified. Contest Entities are not responsible for incorrect or inaccurate transcription of Entry Information, and/or incomplete upload of Answers or Photo. If, for any reason, Contest is not capable of running as originally planned, Sponsors at their sole discretion, reserves the right to cancel, suspend or modify Contest or any portion(s) thereof and conduct the judging from among all salvageable eligible Entries received, if any. Any person attempting to defraud Sponsors or tamper with Contest in any way will be prosecuted to the full extent permitted by law and will not be eligible for a prize. Once submitted, Entries (including Answers and Photos) become the sole property of Sponsors and may not be acknowledged and will not be returned. By entering Contest, entrant assures Sponsors that their Answers and Photo are wholly original and his/her own creations, and that the entrant is the sole owner of all rights (other than Sponsors') relating to all Answers and Photos. Each entrant agrees to indemnify and hold harmless the Contest Entities from any and all liability resulting or arising from use of any submitted Answer and/or Photo. In case of a dispute over the identity of an entrant who submitted a Grand Prize or Finalist Entry on-line, the authorized account owner of the email account associated with that Entry will be deemed the entrant, at Sponsors' sole discretion. "Authorized account holder" of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
10. Grant of Rights: Each entrant unconditionally assigns and transfers all rights, title, interest, claim, ideas, concepts, copyrighted materials and trademarks contained in Answers and Photo and any and all rights including "moral rights" in the Answers and Photo to the Sponsors. Entrant unconditionally assigns and transfers to Sponsors all rights, title, interest, and claim, which he or she now has, or may in the future have to his/her Entry (including Answers and Photo). Sponsors have the right to use, assign, modify, edit, adapt, dispose, and electronically alter entrant's Answers and Photo, including but not limited to, for moral rights, to appear in promotional and/or commercial materials, as well as to reproduce them, in whole or in part, without compensation or additional consent from entrant or any third party.
11. Publicity Release: Notwithstanding anything to the contrary in Sponsors' privacy policy located at http://www.usanetwork.com/privacy/ except where prohibited by law, participation in Contest and/or acceptance of a prize constitutes permission for Sponsors to use, without notice or further compensation, worldwide and in perpetuity, any entrant's or winner's Answers, Photo, name, address (city and state), photo, likeness, biographical information, statement and voice in any and all media for any purpose, including without limitation, advertising and promotional purposes as well as in, on or in connection with the Upcoming Episode, the Web Site or the Contest or other promotions, and hereby release the Contest Entities from any liability with respect thereto.
12. Disclaimers: Contest Entities are not responsible or liable for multiple Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or for Entries including Answers and Photos that are late, destroyed, mutilated, forged, lost, stolen, misdirected, tampered with, incomplete, deleted, damaged, mechanically duplicated, or otherwise not in compliance with these Official Rules and all such Entries will be disqualified. By participating, entrants agree that Contest Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death, as well as claims based on publicity rights, defamation, and/or invasion of privacy) in connection with this Contest, including participation or the acceptance, receipt, possession, misuse, nonuse or use of any prize (or portion thereof); incorrect or inaccurate transcription of Entry Information; acceptance, use or misuse of the Trip or any prize awarded herein; (including, but not limited to, cancellations and delays or any change by the air carrier(s), or other company or any other persons providing any of these services for the Grand Prize Winner and his/her guest during the Trip the Grand Prize winner won due to reasons beyond control of Sponsors and/or Contest Entities); human error; incorrect or inaccurate transcription of Entry Information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or internet service provider utilized by Contest; interruption or inability to access Contest Web Site, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant's (or any third person's) computer and/or its contents related to or resulting from any part of Contest; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of one of the Contest Entities; and waives all rights to claim direct, indirect, punitive, incidental and/or consequential damages, attorney fees or any damages other than actual out-of-pocket costs incurred to enter;. Contest Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of the prize suppliers or any of their agents, servants, employees or independent contractors, (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of Sponsors, or (3) by any other cause, condition or event whatsoever beyond the control of Sponsors and other Contest Entities. Entrants agree to release all rights to bring any claim, action, or proceeding against the Contest Entities.
13. Nature of Relationship/Waiver of Equitable Relief: Each entrant hereby acknowledges and agrees that the relationship between the entrant and the Contest Entities is not a confidential, fiduciary, or other special relationship, and that the entrant's decision to provide his/her Answers and Photo to Sponsors for purposes of the Contest does not place the Contest Entities in a position that is any different from the position held by members of the general public with regard to elements of the entrant's Answers and Photo. Each entrant understands and acknowledges that the Contest Entities have wide access to ideas, stories, designs, and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each entrant also acknowledges that many ideas or stories may be competitive with, similar or identical to the Answers, Photo and/or each other in theme, idea, plot, format or other respects. Each entrant acknowledges and agrees that such entrant will not be entitled to any compensation as a result of any Contest Entity's use of any such similar or identical material. Each entrant acknowledges and agrees that the Contest Entities do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the Answers and Photo. Finally, each entrant acknowledges that, with respect to any claim by entrant relating to or arising out of a Contest Entity's actual or alleged exploitation or use of any Answer, Photo or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable entrant will not be irreparable or otherwise sufficient to entitle such entrant to seek injunctive or other equitable relief or in any way enjoin the production, distribution, exhibition or other exploitation of the Upcoming Episode or any other production based on or allegedly based on the Answer and/or Photo and entrant's rights and remedies in any such event shall be strictly limited to the right to recover damages, if any, in an action at law.
14. Dates & Deadlines/Anticipated Number of Contestants: Because of the unique nature and scope of the Contest, Sponsors reserve the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Contest. Sponsors cannot accurately predict the number of entrants who will participate in the Contest.

Rules/Winner Information: To receive the names of the winner(s) or an additional copy of these Official Rules, send a self-addressed stamped envelope to: Quiznos® Character Fantasy Contest "Rules"/"Winner Information" (specify which), P.O. Box 11389, Burbank, CA 91510. All requests must be received by July 25, 2008. Official Rules will also be accessible on the Web Site. Winner's name may also be posted on the Web Site.
